John Merlo secures injunction to stop heavy earthmoving plant being disposed of at auction
Recently, I obtained an ex parte injunction against an auction company, a foreign national and a New South Wales company stopping them from disposing of millions of dollars of heavy earth-moving plant, or dealing with them in any way, including removing them from the jurisdiction.
Working very closely with the client and it’s associates under a very tight time frame, I put together and presented carefully constructed affidavit and appeared before the Supreme Court demonstrating ownership and immediate risk which was insusceptible to being remediated by damages in litigation. An urgent ex parte injunction was granted. The matter proceeded and was ultimately resolved.
